1. Selection criteria
Only candidates or tenderers meeting the defined selection criteria may participate in public procurement. The selection criteria always depend on the specific type of the contract or concession award procedure.
Individual documents to prove conformity with exclusion grounds and selection criteria can also be replaced by the ESPD - the European Single Procurement Document (as a preliminary evidence) or registration in the List of Economic Operators, or registration in an equivalent foreign register of economic operators.
2. Personal situation
With regard to personal status, eligibility to supply the goods, perform works or provide services has to be demonstrated. Furthermore, integrity (extract from the judicial record) has to be demonstrated, and for duties relating to taxes and social and health insurance contributions, a confirmation from the relevant institution (tax administrator, insurance company) of having no arrears or liabilities past their due date has to be submitted. To demonstrate there is no ban on participation in public procurement, a self-declaration is sufficient – the contracting authority/entity checks conformity with the criterion in the List of Banned Entities (the webpage is available only in Slovak), published on the website of the Office for Public Procurement.
If you are a foreign candidate or tenderer (you do not have the registered office or place of business in the Slovak Republic), you have to prove conformity with the selection criteria by equivalent documents issued in your home country. If your home country does not issue such documents, submit a self-declaration. If the legal order of your country does not recognize such self-declarations, you may submit a declaration made before a court, administrative authority, notary, other professional or commercial institution, depending on what is possible under your national legislation.
The contracting authority or contracting entity should indicate in the contract notice or in the call for competition which documents the tenderer does not have to submit if the information is available in the relevant public administration information systems.
The Act on public procurement defines the list of all selection criteria and how they should be demonstrated.
3. Economic and financial standing
The contracting authority/entity specifies selection criteria relating to the financial and economic standing in the contract notices. They may involve e.g. confirmations from banks, insurance companies or providing documents with accounting indicators.
You can rely on resources of other entities to prove your financial and economic standing, provided that you will actually use that entity’s resources to perform the contract, as evidenced by a written contract on that person’s commitment to perform the contract throughout its duration. At the same time, however, the provider of resources must demonstrate conformity with the selection criteria regarding personal situation, with the exception of the criterion relating to the eligibility to supply the goods, perform the works or provide the services, and there may not be any specific grounds for exclusion applying to the provider.
4. Technical ability
To demonstrate technical abilities, lists of works carried out in the past are usually required. This may include an indication of professional and/or technical and managerial staff, information on the average number of employees, information on technical, research equipment and machinery, indication of adopted environmental management measures, etc.
You may also rely on technical and professional abilities of other entities. However, the condition also applies that the capacities of the person whose capacities are used to prove technical or professional abilities will actually be used in the performance of the contract or concession contract. This fact has to be evidenced by a written contract on that person’s commitment to provide capacities throughout the duration of the contractual relationship.
