Designations of origin and geographical indications protect items the quality or characteristics of which stem from natural conditions or are associated with a specific geographical territory by reputation, tradition or recognised name with a geographical origin. The following article provides information on the conditions of granting, rights of a trade mark proprietor and on submitting applications.

1. What is the subject-matter of designations of origin and geographical indications for
products?
- Agricultural products, foodstuffs, wine, spirit drinks, mineral water, artisanal goods, the quality and characteristics of which stem from natural conditions or are associated with a specific geographical area by reputation, tradition, recognised name which has a geographical origin (e.g. Skalický trdelník).
- In general, protection is granted on national, international and European Union level.
- Agricultural products and foodstuffs may only be registered and protected at European Union level.
2. Who may submit applications for designations of origin or geographical indications?
- An association or union of producers regardless of its legal form;
- an association or union of processors regardless of its legal form;
- natural person or legal entity autonomously, if at the time of applying it is the only entity producing or processing the product in a defined territory.
3. What are the application requirements for designations of origin or geographical
indications?
The application shall include
- Identification data and signature of the applicant (or identification data and signature of the representative);
- Name and registered office of the establishment;
- Wording of the designation of origin or geographical indication;
- Geographical definition of the territory;
- Product type (wine, spirit drink, mineral water, etc.);
- Document confirming that the product originates in the defined territory;
- Description of the product’s characteristics or quality traits;
- Description of the process by which the product is obtained;
- In addition, the administrative fee of EUR 50 shall be paid.
