An employee in working relations has the right to be heard at the workplace directly, or indirectly through employee representatives.

Indirect representation means representation through a trade union that is set up at the workplace and registered at the Slovak Ministry of Interior or through a higher union body. Employees may also be represented by an employee trustee or works council. The ‘plurality principle’ means that different types of employee representation may be established in the same workplace.

In the same workplace there could be:

  • a trade union and a works council;
  • a trade union and employee trustee.

The activities of works councils and employee trustees are mutually exclusive.

Works councils and employee trustees are elected by vote.

Relations between trade unions and employers are governed by the Collective Bargaining Act. The main function of a trade union is collective bargaining. The objective of collective bargaining is to conclude a collective agreement.

A collective agreement applies to all employees in a workplace, not only the members of the trade union.

The representation of employees is voluntary.

The competences of works councils, employee trustees and trade unions are regulated by the Labour Code.
