In order to log into the electronic mailbox established according to the Act No. 305/2013 Coll. on e-Government, an owner of the electronic mailbox needs:
- an identification card with an electronic chip (eID card) and personal security code (BOK),
- in case of foreigners - residence card with an electronic chip, or
- alternative authenticator.
A foreign person cannot obtain an eID card since it is bound to being a citizen of the Slovak Republic. Therefore, if a legal entity has a foreign statutory representative, in order to have a full access to its electronic mailbox, he must authorize (entitle) a natural person – citizen of the Slovak Republic, with an eID card, to have a full access to its electronic mailbox.
An application for authorization to access the electronic mailbox of a legal entity, shall be sent in a paper form to the following address: Národná agentúra pre sieťové a elektronické služby, Tower115, Pribinova 25, P.O.BOX 5, 810 08, Bratislava. The application must contain a certified signature of the statutory representative authorized to act on behalf of the legal person.
The application for authorization can be submitted also electronically. In this case, the owner of the electronic mailbox sends the scanned application for authorization with an officially certified signature of the statutory representative through the electronic services „Všeobecná agenda“ addressed to National Agency for network and electronic services. However, it is also necessary to send the original application with an officially certified signature of the owner of the electronic mailbox in paper form to the following address: Národná agentúra pre sieťové a elektronické služby, BC Omnipolis, Trnavská cesta 100/II, 8210 01 Bratislava.
If the signature of the foreign statutory representative is verified outside the Slovak Republic, an apostille should be affixed (apostille is required in case of any signatory state of the Apostille Convention – The Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents). In case of non-signatory countries of the Apostille Convention, a superlegalization is required.
Issue of the residence card for foreigners is regulated by Act no. 404/2011 Coll. The residence card for foreigners has an electronic chip, which is issued upon request by the competent police department.
Access to electronic mailboxes via alternative authenticator is not yet available. The Ministry of Interior is responsible for its issue. In the meantime, the foreign statutory representative of the legal entity will proceed according to the afo;rstated process.
